1. About PubHols
PubHols is a public holiday and business-day API operated from Australia (“PubHols”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, API, and related services (the “Service”).
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Accounts and API keys
Some parts of the Service require an API key. You are responsible for keeping your API key secure and for all activity that occurs using your API key.
You must not share, publish, or embed your API key in client-side code where it can be extracted by others.
3. Acceptable use
You agree not to:
- misuse, disrupt, or attempt to interfere with the Service
- attempt to bypass authentication, rate limits, quotas, or security controls
- use the Service for unlawful, abusive, or harmful purposes
- resell or redistribute the Service unless we agree in writing
4. Plans, billing, and renewals (paid plans)
If you purchase a paid plan, you agree to pay the fees shown at the time of purchase. Paid plans may be billed monthly or annually, and may auto-renew unless cancelled before the renewal date.
- Taxes: Prices may be inclusive or exclusive of GST depending on how you present pricing. If GST applies, it will be shown at checkout/invoice.
- Changes: We may change plan features, pricing, and limits over time. Any changes apply from your next renewal unless stated otherwise.
- Non-payment: If a payment fails or is overdue, we may suspend or reduce access until payment is resolved.
- Refunds: Unless required by law, fees are generally non-refundable. If you cancel, you will usually keep access until the end of your billing period.
5. Rate limits and quotas
Your use of the API is subject to rate limits and usage quotas (including per-day and per-month limits). We may enforce limits to protect reliability and fair use.
6. Data accuracy and availability
We aim to provide accurate holiday and event data, but holiday rules and dates can change and may differ by jurisdiction. The Service is provided on an “as is” and “as available” basis and may not be error-free or uninterrupted.
7. No warranties
To the maximum extent permitted by law, we exclude all warranties (express or implied), including fitness for a particular purpose. Nothing in these Terms excludes consumer guarantees that cannot be excluded under Australian Consumer Law.
8. Limitation of liability
To the maximum extent permitted by law, PubHols is not liable for indirect or consequential losses, loss of profits, loss of revenue, loss of data, or business interruption.
To the extent we are liable for a claim relating to the Service, our total liability is limited to the amount you paid to PubHols in the 12 months before the event giving rise to the claim.
9. Intellectual property
We own the Service, including our code, branding, and documentation. You receive a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
10. Suspension and termination
We may suspend or terminate access to the Service where reasonably necessary for security, legal, or operational reasons, including suspected misuse or breaches of these Terms.
You may stop using the Service at any time.
11. Governing law
These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.
12. Changes to these Terms
We may update these Terms from time to time. The latest version will be published on our website. Continued use of the Service after changes take effect means you accept the updated Terms.
